Terms of Use
These Terms of Use ("Terms") are an agreement between you and Trackseam ("we", "us") governing your use of the Trackseam mobile apps and website (the "Service"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract. You are responsible for the accuracy of your account details, for keeping your password confidential, and for all activity under your account. Tell us promptly at contact@trackseam.com if you suspect unauthorised use.
2. Your content and your clients
You keep ownership of the information you enter, including client details and measurements ("Your Content"). You grant us a limited licence to store, process and display Your Content only as needed to provide the Service to you. You confirm that you have your clients' permission, or another lawful basis, to record their personal information and measurements, and that you will handle it in line with applicable data protection law.
3. Acceptable use
You agree not to:
- use the Service for anything unlawful, or to store content you have no right to store;
- attempt to access other users' accounts or data, or probe, scan or test the Service's security without permission;
- interfere with or overload the Service, or access it with bots or scripts other than through the apps and website we provide;
- copy, resell, reverse engineer or create derivative works of the Service except as the law allows.
4. Availability and changes
We aim to keep the Service available and your data safe, but we do not guarantee uninterrupted or error-free operation. We may change, suspend or discontinue features. If we discontinue the Service entirely we will give reasonable notice so you can export your records. You are responsible for keeping your own copies (for example PDF exports) of records that matter to your business.
5. Fees
The Service is currently free of charge. If we introduce paid features, we will tell you the price and terms before you are charged, and purchases in the iOS or Android apps will be processed by Apple or Google under their terms.
6. Measurements disclaimer
Trackseam stores the figures you enter. We are not responsible for the accuracy of measurements, for garments made from them, or for disputes between you and your clients.
7. Termination
You may stop using the Service and delete your account at any time from the app or at the account deletion page. We may suspend or close accounts that breach these Terms or put the Service or other users at risk. Sections 2, 6, 8, 9 and 11 survive termination.
8. Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
9. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or USD 50. Nothing in these Terms limits liability that cannot be limited by law.
10. App store terms
If you downloaded the app from the Apple App Store or Google Play, these Terms are between you and us, not Apple or Google. In addition:
- Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support for it, and is not responsible for any product, intellectual-property or legal claims relating to it. To the maximum extent permitted by law, Apple has no other warranty obligation; if the app fails to conform to an applicable warranty you may notify Apple, which may refund the purchase price (if any). Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and are not on any U.S. Government list of prohibited or restricted parties. Your use of the app must also comply with Apple's Licensed Application End User License Agreement and the App Store Terms of Service.
- Google. Your use of the Android app is also subject to the Google Play Terms of Service.
11. Governing law
These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-law rules. Mandatory consumer-protection laws of your country of residence still apply where they give you more protection.
12. Changes to these Terms
We may update these Terms. We will change the effective date above and, for material changes, notify you in the app or by email before they take effect. Continuing to use the Service after that means you accept the updated Terms.
